ARTICLE 2 - Definitions

  • Provider: The company WINK providing the CV parsing service via an API connection.
  • User: Any individual or legal entity using the service through the API provided by the Provider.
  • Service: A CV parsing solution that extracts and structures data from CVs submitted via the API.
  • API: An application programming interface provided by the Provider to access the Service.

ARTICLE 3 - Purpose and Acceptance of the TCU

These Terms and Conditions of Use (TCU) define the terms of use of the CV parsing service provided by the Provider.

Access to and use of the Service imply full acceptance of these TCU. The User acknowledges having read and understood the TCU prior to using the Service.

The Provider reserves the right to amend the TCU at any time. The new TCU will take effect as soon as they are published on the Provider's website or communicated to the User.

ARTICLE 4 - Access to the Service and API Connection

4.1. Access Request

To use the Service, the User must:
- Create an account with the Provider and provide the necessary information to configure API access.
- Obtain the API authentication keys provided by the Provider.

4.2. Availability

The Service is accessible 24/7, except for planned maintenance or force majeure. The Provider strives to ensure maximum availability of the Service but cannot be held liable for unforeseen interruptions.

4.3. Security of Access

The User is responsible for securing their API authentication keys. Any unauthorized use of the API keys is the sole responsibility of the User.

ARTICLE 5 - Use of the Parsing Service

5.1. Service Functionality

The Service allows the User to send CVs in electronic formats (PDF, DOCX, etc.) via the API. Extracted data (name, first name, contact information, professional experience, education, etc.) are returned in a structured format (JSON, XML, etc.).

5.2. Usage Restrictions

The User agrees not to:
- Use the Service for illegal purposes or in violation of applicable laws, particularly data protection regulations (GDPR).
- Submit files containing sensitive or confidential data without proper consent.
- Divert the Service for purposes other than those intended by these TCU.

5.3. Minimum Volume

There is no minimum volume requirement for using the Service.

ARTICLE 6 - User Obligations

6.1. Compliance with Laws

The User is solely responsible for the data they submit via the API and ensures compliance with applicable laws, particularly concerning the collection and processing of personal data.

6.2. Accuracy of Information

The User agrees to provide accurate and complete information when registering and using the Service.

6.3. Use of Extracted Data

The User is responsible for the use of the extracted data. The Provider cannot be held responsible for the consequences of their use.

ARTICLE 7 - Provider's Liability

The Provider undertakes to provide the Service under the conditions described in these TCU. However, the Provider shall not be held liable in the following cases:
- Misuse of the Service by the User.
- Service interruption due to force majeure, maintenance, or any event beyond the reasonable control of the Provider.
- Losses or damages resulting from the use of the extracted data, which remain the sole responsibility of the User.
- Violation of applicable laws by the User in the context of using the Service.

ARTICLE 8 - Privacy Policy

The User agrees to review this policy before using the Service.

ARTICLE 9 - Data Retention

The Provider ensures that all data transmitted through the API is retained in compliance with the General Data Protection Regulation (GDPR).
